1. General

1.1. These general terms and conditions of sale (“Conditions of Sale”) are valid between customers and H.I.S. Travel Nederland B.V. (“HIS Travel”, “we” or “us”) and apply to all orders for the purchase of products (“Products”) on the website (“Website”).

1.2. The sale of Products under the Conditions of Sale is only available to customers, which are natural persons acting for purposes extraneous to their trade, business, craft and profession, aged over 18 (or have parental or guardian consent to place an order), for their personal use (“Customer(s)” or “you”).

1.3. The Conditions of Sale apply to the conclusion, contents and execution of the agreement between you and HIS Travel concerning the sale of Products through the Website (“Agreement”), as well as to all other legal acts and relationships between HIS Travel and Customer. 

1.4. HIS Travel may change the Conditions of Sale from time to time without notice. Customers are responsible for keeping updated with changes in the Conditions of Sale. Please note that the Conditions of Sale that are valid for your order, are always the Conditions of Sale in effect as of the time you place your order. We recommend that you save a copy of these Conditions of Sale on your computer.

1.5. HIS Travel explicitly waives the applicability of any other terms that you seek to impose or incorporate.

1.6. The invalidity of one or several provisions of the Conditions of Sale shall not affect the validity of the remaining provisions. 


2. Identification of HIS Travel and Affiliates

The Website is exploited by H.I.S. Travel Nederland B.V., a private company with limited liability, having its registered office in Amsterdam at Arent Janszoon Ernstraat 595 E (1082 LD), the Netherlands, registered with the Dutch Chamber of Commerce under number 34299265 (HIS Travel). 

The Products purchased on the Website are sold by HIS Travel but the Products will be shipped and delivered by either HIS Travel itself or one of its affiliates (Affiliate), whichever is closest to the delivery address.


3. Information on Products 

3.1. The main characteristics of the Products are shown on each product page on the Website. The images and colours of the Products displayed on the Website may not exactly correspond to reality due to the Internet browser or monitor used.

3.2. The prices of the Products are indicated on the Website in the applicable currency and are inclusive of all applicable taxes and charges. Delivery costs, if required, shall be added to the price of the Products and will be calculated and indicated separately before or during the checkout.

3.3. HIS Travel cannot guarantee the absence of errors. In the event that an error in the pricing of a Product is detected, HIS Travel shall refuse the order and offer you the opportunity to purchase the Product at the correct price. If the error is detected after the order has been accepted, HIS Travel will also offer you the opportunity to cancel the order.

3.4. HIS Travel aims to describe the Products on the Website as correctly as possible. However, as a result of different image acquisition, display technologies, or other technical reasons, minor differences in colour and other variations in item(s) are possible. We cannot be held responsible for any such discrepancy.

4. Conclusion of the Agreement

4.1. By placing an order, you are offering to purchase a Product on and subject to the Conditions of Sale. All orders are subject to availability and confirmation of the order price by HIS Travel. 

4.2. To purchase the Products, Customers should (i) include the selected Products in the “Shopping Bag” by clicking on the relevant button, (ii) fill in the order form, (iii) select the payment method, (iv) accept the Conditions of Sale, and (v) send the order proposal to HIS Travel through the Website. 

4.3. Sending of the order constitutes a proposal to purchase the selected Products, regulated under these Conditions of Sale, and binding for the Customer, with no prejudice to the withdrawal right under Clause 7. Moreover, the order proposal sent by the Customer entails the obligation to pay the price of the Products ordered.

4.4. HIS Travel is entitled, at its discretion, to refuse your order without any liability to you. By a way of example (but without limitation), HIS Travel may refuse your order in the following events: 

  • the Products ordered are unavailable;
  • it is impossible to obtain authorisation of the payment within the due deadline;
  • if we suspect any fraudulent activity;
  • if shipping restrictions apply to a Product.

4.5 In case of unavailability of one or more of the Products, we will inform you of the unavailability of the Products by e-mail. In this case the order proposal will be cancelled or partially accepted just in relation to the available Products. In case of partial acceptance, the Customer shall pay only the price of the available Products.

4.6. The Agreement is executed upon receipt by the Customer of the acceptance by HIS Travel of the order proposal ("Order Confirmation"), which is sent after your payment has been completed. The acceptance (or the refusal) by HIS Travel shall be sent to the Customer via e-mail at the address provided by the Customer in the order proposal.

4.7. The Order Confirmation will include a summary of the essential characteristics of the purchased Products, a detailed indication of the price and means of payment, information on delivery charges, if any, information on the conditions and methods to exercise the right of withdrawal, the address to which complaints may be addressed, information on customer support services, and a link to these Conditions of Sale.

4.8 The order cannot be cancelled or modified once the Order Confirmation is sent to the Customer. However, you are entitled to withdraw your purchase and to return the dispatched Products as set out in Clause 7 below.

5. Payment 

5.1. Payment of the price of the Products and their shipping costs should be made using one of the payment methods indicated on the order form. 

5.2. HIS Travel shall send an invoice for the purchase of the Products by e-mail, pursuant to the applicable laws and regulations. The invoice will be based upon the information provided by Customer at the time of the order. No alterations to the invoice are possible after the invoice has been issued.

5.3. Local charges (customs duty, sales tax) may apply, depending on your region and local customs duties. The charges are at your own expense.


6. Shipping and delivery 

6.1. Once the Products are dispatched, HIS Travel shall send to Customer a shipping confirmation by e-mail and the estimated delivery period.

6.2. HIS Travel aims to deliver your order within estimated delivery period as indicated to you. However, sometimes deliveries may take longer. If you have not received your delivery within two workings days after expiry of the estimated delivery period, please contact our customer service. Saturday and Sunday are not considered working days. HIS Travel is not held responsible for any delays resulting from postal delays.

6.3. The exact shipping rates depend on the country to which your order is being delivered. All packages are insured and have a tracking number so the package can be tracked. This tracking number will be shared in the shipping confirmation e-mail.

6.4. Risk of loss of or damage to the Products shall pass to you when you (or a third party other than the carrier and designated by you) take physical possession of the Products.

6.5. If your order contains Products with alcohol, you are required to show a valid identification showing your date of birth at the time of delivery. If the minimum age requirement of 18 years is not met, the delivery company is forced to take the package back. In that case, we will cancel your order and charge you with a cancellation fee of €10.00.


7. Withdrawal and return policy 

7.1. You have the right to withdraw unused purchased Products within 14 days from the date in which you obtain the physical possession of the Product, without giving any reason. To return the Products, the Customer should follow the return policy as set out on the return form enclosed in every package.

7.2. The withdrawal right within the meaning of Clause 7.1 does not apply to Products that are not suitable for return due to health and hygiene reasons, including but not limited to, beverages with an expiry date, gift cards, vouchers, tobacco products, unsealed jewellery, unsealed DVDs, CDs or video games.

7.3. Return costs are at the Customer’s own expense.

7.4. Customers are allowed to return Products to a physical HIS Travel store. You will not be charged a fee for returning the Product at a store.

7.5. HIS Travel shall reimburse all payments received from the Customer, excluding the costs of delivery, if any, within 14 (fourteen) days of the day on which the relevant Affiliate/HIS Travel has received the Products back, or until the Customer has supplied evidence of having sent back the Products. Reimbursement shall be executed by HIS Travel using the same means of payment as the Customer used for the initial transaction.

7.6. HIS Travel reserves the right to refuse the return of the Products if it appears that the Products are worn, used and/or damaged. 


8. Applicable law and competent court 

8.1. The Conditions of Sale, and all Agreements ensuing therefrom are exclusively governed by, and be interpreted in accordance with the laws of the Netherlands. All disputes arising out of the Conditions of Sale between HIS Travel and Client shall be submitted to the competent court in Amsterdam, the Netherlands. However, HIS Travel shall have the right to bring a dispute before the court within whose jurisdiction Customer has its place of residence or domicile.

8.2. Applicable national law governing the sale of consumer goods takes precedence over the rules as laid down in these Conditions of Sale, insofar national law deviate from these rules. 

8.3. Alternatively, the Client can decide to access the platform for online dispute resolution provided by the European Commission, available on the website
